SECTION 460:20-13-6. Coal exploration compliance duties

  • (a)   All coal exploration and reclamation which substantially disturbs the natural land surface or which removes more than 250 tons of coal shall be conducted in accordance with the coal exploration requirements of the Act, this Subchapter, Subchapter 41, and the regulatory program and any conditions on approval for exploration and reclamation imposed by the Department;
    (b)   Any person who conducts any coal exploration operations in violation of 45 O.S. 1981, Section 745.11, the provisions of this Subchapter, Subchapter 41, the regulatory program or any exploration permit term or condition imposed by the Department shall be subject to the enforcement provisions of 45 O.S. 1981, Section 769, and the inspection and enforcement provisions of this Chapter and the regulatory program.
