SECTION 375:30-5-4. Notification of parties when a potential DNA database match occurs

- (a) When the DNA analysis of evidence submitted to the DNA laboratory matches the DNA profile of an offender in the CODIS database:(1) the CODIS laboratory shall re-examine the DNA offender sample according to current CODIS policy and procedures to verify the result,(2) the OSBI shall attempt to verify the identity of the sample donor fingerprint submitted with the DNA offender sample.(b) The CODIS laboratory shall notify all appropriate agencies.(c) After being notified of a potential match, the district attorney's office or the submitting agency shall make an arrangement to have a DNA sample taken from the offender or suspect whose DNA offender profile matches the DNA in the evidence.
